Diana Jenkins is no longer pursuing action against the person or people responsible for the racist bot attacks Garcelle Beauvais‘ son, Jax Nilon, was faced with amid the 12th season of The Real Housewives of Beverly Hills.
After filing a lawsuit to uncover the identities of those who cyberbullied the teen boy in 2022, saying she hoped to “unmask and hold accountable the morally bankrupt person who has attacked a child,” Diana has confirmed she’s putting an end to the case.
In her court filing on Wednesday, which Radar Online obtained on May 11, Diana said that after the court “expressed concerns” that she wasn’t the right person to lead the lawsuit, her team reached out to Garcelle’s lawyer to ask “if she would join the lawsuit as Plaintiff.”
But while Diana “offered to cover all her legal expenses in connection with the suit,” she “did not receive a response from [Garcelle].”
Diana, who is currently pregnant, also reached out to NBC Universal, the parent company of Bravo, “and informed NBC Universal regarding her efforts to identify the perpetrator(s), but also received no response.”
“In light of the lack of response and assistance and despite having spent tens of thousands of dollars, Ms. Jenkins has concluded that she cannot proceed with this litigation at this time,” her recent filing stated. “Ms. Jenkins is filing a Request of Dismissal Without Prejudice.”
According to the report, Diana had been getting closer to identifying the person or people behind the disturbing attacks on Jax before dropping her lawsuit.
“Many of the Instagram account holders had concealed their identities by using disposable email addresses and foreign phone numbers,” the lawsuit explained. “[Diana] worked with a computer forensic expert [who] identified a potential name behind one of the accounts” with IP addresses in Northern California.
There were also links to West Africa’s Ivory Coast and Mongolia. And the first initial and last name of one possible culprit was shared.
“[Despite identifying] service providers for the IP addresses such as Comcast and Verizon, [Diana] “could not determine the persons who were using the IP addresses,” Diana’s filing shared.
In January, after confirming she’s expecting her fourth child, the second for her fiancé, Asher Monroe, Diana confirmed she would not be featured on RHOBH season 13.
“As so many of you know, Asher and I are expecting our second child later this year. You also know that due to many factors, this pregnancy is considered high risk and I am on doctor-advised bed rest. To that end, I am not able to devote myself fully to filming the next season of Real Housewives of Beverly Hills,” she announced on Instagram. “I would like to thank Bravo and Evolution for allowing me to focus on my pregnancy, and for their support and understanding.”
The Real Housewives of Beverly Hills season 13 is currently in production and expected to begin airing on Bravo sometime later this year.
